Fuoco in Zona — to be read together with the privacy policy

1. What Fuoco in Zona is

Fuoco in Zona is a monitoring service that reports, via Telegram and/or email, the detection of heat points from public satellites (NASA FIRMS, Meteosat/EUMETSAT) within a radius set by the user around the land plots the user has registered.

2. How detection works and its technical limits

The service receives and processes data published by independent third parties:

• NASA FIRMS (VIIRS/MODIS satellites) — publishes data with a latency that can reach up to a few hours relative to the actual event.
• Meteosat/EUMETSAT — more frequent coverage (about every 15 minutes), but with less precise geographic resolution.

These limitations (latency, resolution, the possibility that the satellites themselves fail to detect an event) do not depend on us: we receive and forward the data exactly as published by the official sources, with no ability to change their accuracy or timeliness at the source. A delay or a missed detection attributable to third-party satellite data does not constitute a breach of the service.

3. Registration and account

• To register you must be at least 18 years old and have the legal capacity to enter into contracts, or act as an authorized representative of a farming business or professional activity.
• The data you provide during registration (name, email, land data) must be truthful and kept up to date.
• You are responsible for keeping your login credentials confidential and for all activity carried out through your account. If you suspect unauthorized access, write to us immediately at ciao@fuocoinzona.it.
• Each user has a single personal account; if you manage several plots belonging to the same farming business, you add them all to the same account.

4. Prices, payment and renewal

• The subscription price is the one shown on the site at the time of subscription, based on the plan chosen (number of plots that can be monitored).
• Payments are processed by Stripe; billing data is also processed by Safe Publishing Ltd as indicated in the privacy policy.
• The subscription renews automatically at expiry (12 months from subscription, or from the last renewal), with automatic charge to the same payment method used, unless cancelled before the renewal date.
• You can cancel at any time by writing to ciao@fuocoinzona.it: cancellation stops the next renewal, and the service remains active until the end of the period already paid for.
• You can renew early at any time, at the price in effect on the day of early renewal.

5. Right of withdrawal

If you subscribe to the service as an individual for purposes unrelated to your professional activity (a "consumer" under the Italian Consumer Code), you have the right to withdraw from the contract within 14 days of subscribing, without giving any reason, pursuant to Article 52 of the Italian Consumer Code. To exercise this right, write to ciao@fuocoinzona.it.

If you expressly request that the service begin immediately (e.g. immediate activation of alerts) and knowingly accept this condition, you lose the right of withdrawal once the service has been fully performed, pursuant to Article 59 of the Italian Consumer Code. This right does not apply if you subscribe in the course of your professional/business activity (e.g. running your farming business) — which is the case for the vast majority of our users, as indicated in section 10.

6. Suspension and termination of the account

• We may suspend or close your account in the event of: failure to pay a renewal, improper use of the service (e.g. unauthorized access, false data), or violation of these terms.
• You can close your account at any time by writing to ciao@fuocoinzona.it; your data is handled as indicated in the privacy policy.

7. Intellectual property

• The software, the name "Fuoco in Zona" and the site's content are the property of the service owner (section 14) and may not be copied, modified or redistributed without authorization.
• The data you enter (land plots, uploaded documents) remains yours; you authorize us to process it solely to provide the service, as described in the privacy policy.

8. Limitation of liability

To the extent permitted by Italian law:

• Our liability for any damages arising from use of the service is limited to damages reasonably foreseeable at the time of subscription, pursuant to Article 1225 of the Italian Civil Code, and in any case not exceeding the amount paid for the subscription in the 12 months preceding the event.
• Liability for willful misconduct or gross negligence, and liability for death or personal injury caused by our fault, remain always unaffected, and are in no way excluded or limited by these terms, pursuant to Article 1229 of the Italian Civil Code.
• We are not liable for malfunctions, delays or interruptions of third-party services we depend on (NASA FIRMS, EUMETSAT, Telegram, email providers, hosting), nor for their accuracy.

9. Specific consent to this clause and to the jurisdiction clause

Pursuant to Articles 1341-1342 of the Italian Civil Code, the clauses in sections 8 (Limitation of liability) and 10 (Jurisdiction) require specific, separate approval, which is requested explicitly during registration, distinct from general acceptance of these terms.

10. Governing law and jurisdiction

These terms are governed by Italian law. For any dispute relating to this service, the Court of Bari ("Foro di Bari") has exclusive jurisdiction.

Note: this jurisdiction clause applies to users who subscribe to the service in the course of their professional/business activity (e.g. running their own farming business), which is expected to be the case for the vast majority of our users. For users who qualify as a "consumer" under the Italian Consumer Code, the law mandatorily provides for the jurisdiction of the consumer's place of residence, which prevails over this clause.

11. Assignment of the contract

We reserve the right to assign this contract, in whole or in part, to another entity that may take over management of the service (for example in the event of incorporation as a company), while guaranteeing continuity of terms for you. We will inform you of any such assignment. You may not assign your contract to third parties without our written consent.

12. Changes to the service and to these terms

We reserve the right to modify the service and these terms, giving users reasonable advance notice of substantial changes.

13. Severability

If any clause of these terms is declared void or unenforceable, the remaining clauses remain fully valid and effective.
